A Lasting Power of Attorney (LPA) allows you to choose trusted people to make decisions on your behalf if you ever become unable to do so. At Gladstone Solicitors, our experienced Solicitors provide clear, practical advice to help you put the right arrangements in place for your future.

What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document that allows you to appoint one or more people (your “attorneys”) to make decisions for you if you lose mental capacity or need help managing your affairs.

There are two types:

1. Property & Financial Affairs LPA

Covers decisions about:

• Managing bank accounts
• Paying bills
• Selling or maintaining property
• Pensions and investments
• Day‑to‑day financial management

This can be used with your permission while you still have capacity, or if you lose capacity in the future.

2. Health & Welfare LPA

Covers decisions about:

• Medical treatment
• Care needs and living arrangements
• Life‑sustaining treatment
• Day‑to‑day wellbeing

This can only be used if you lose mental capacity.

We will explain both options clearly and help you decide which is right for you.

Appointments at Home, in Care Homes and Hospices

We understand that many clients who need LPAs may have mobility issues or health concerns. We therefore offer:

• Home appointments
• Care‑home visits
• Hospital and hospice appointments
• Short‑notice appointments, subject to availability

Our Solicitors are experienced in working with vulnerable clients and families, ensuring the process is handled with sensitivity and care.

Capacity and When an LPA Can Be Made

To make an LPA, you must have the mental capacity to understand what the document means. Our Solicitors can:

• Assess capacity sensitively
• Guide families where capacity is borderline
• Explain when a Court of Protection application may be required instead
• Support attorneys who are unsure about their responsibilities

If an LPA cannot be made, we will explain the next steps clearly.

Registration with the Office of the Public Guardian (OPG)

We handle the entire registration process, including:

• Preparing the LPA forms
• Acting as certificate provider if appropriate
• Submitting the application to the OPG
• Dealing with any queries
• Advising attorneys once the LPA is registered

We make the process as smooth and stress‑free as possible.

Professional Attorney Services

For clients who have no suitable family or friends to act, or where independence is important, Gladstone Solicitors can act as professional attorneys.

This can be particularly helpful where:

• There are concerns about family conflict
• The estate is complex
• Vulnerable clients require safeguarding
• A neutral, regulated professional is preferred

Urgent or Emergency LPAs

Where someone’s health is deteriorating or a hospital admission is imminent, we can often prepare LPAs at short notice, subject to availability.

We will always do our best to assist in urgent situations.
